Welcome to the D30 Challenge app. These Terms of Use (“Terms”) govern your use of our mobile application. By accessing or using the app, you agree to be bound by these Terms. Please read them carefully before using the app.

1. Acceptance of Terms

By downloading, installing, or using the D30 Challenge app (“the App”), you agree without reservation to be bound by these Terms. If you do not agree to these Terms, please stop using the App immediately.

2. Description of the App

The D30 Challenge app is designed to help users achieve their fitness goals through personalized nutrition and workout plans, live classes, and progress tracking. Key features include live workouts via Zoom, reminder notifications, weight and measurement tracking tools, and more.

3. Registration and User Account

Registration for the D30 Challenge is done through our official website https://bodyshockgym.com/. To participate in the challenge, you must sign up and pay the specified registration fee on the site. Once your registration is confirmed, you will receive the credentials needed to access the app.

You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account. If you suspect unauthorized use of your account, you must notify us immediately.

4. Payments and Subscriptions

Access to the 60-day challenge through the app requires payment of a registration fee, which must be completed on the website https://bodyshockgym.com/. All transactions are processed through secure payment methods.

No refunds will be provided.

5. Authorized Use

The app is for personal, non-commercial use only. You agree not to:

  • Use the app for illegal or unauthorized purposes.
  • Copy, modify, or distribute any content from the app without prior permission.
  • Interfere with or disrupt the integrity or performance of the app.
  • Transmit any harmful content, including viruses, malware, or other destructive code.

6. Intellectual Property Rights

All content within the app, including text, graphics, logos, images, videos, and software, is protected by copyright and intellectual property laws. You agree not to reproduce, distribute, or create derivative works from the app’s content without prior written consent.

7. Privacy

8. Termination

We reserve the right to suspend or terminate your access to the app without notice if you violate these Terms or if we suspect fraudulent use of the app. You may also terminate your account at any time by going to My Profile > Settings > Delete Account. When you delete your account, all your data will be immediately removed from our systems.

9. Acceptance of Additional Terms

  • You agree that your photos may be used for marketing and advertising purposes related to the D30 Challenge and Bodyshock Gym.
  • The Bodyshock team and the gym shall not be held responsible for any injuries or health issues resulting from the use of the Application or participation in the challenge.
  • No refunds will be provided.

10. Limitation of Liability

The app and its content are provided “as is.” We do not guarantee that the app will be error-free or uninterrupted. To the fullest extent permitted by law, we disclaim all liability for any direct, indirect, or consequential damages arising from the use or inability to use the app.

11. Changes to the Terms

We reserve the right to modify these Terms at any time. Any changes will be communicated via the app and will take effect upon publication. Continued use of the app after any modifications indicates your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Canada, and any disputes will be subject to the exclusive jurisdiction of the courts of Canada.
